General terms and conditions

In addition to the (digital) agreement, the following general terms and conditions apply unless an exception has been made by email (or otherwise in writing).

Promotional materials:
Here you will find promotional photos and texts. For the promotion of an event where Jannes performs, the use of accompanying material is free of rights, provided that the original intent remains intact. Use of this material for or by third parties is not allowed unless explicitly agreed upon. (e.g. for educational projects)

Liability insurance:
Artist has a liability insurance.

Performances in public space:
If legal restrictions apply to the performance at the location, the client is responsible for the necessary permits.

Parking:
Client provides a free parking space within walking distance.

Dressing room or break room:
The client also provides a lockable or safe changing room as a "base of operations". A (heated if necessary) room of 2 x 2 m with sufficient light is in principle already sufficient. If such a space is not available (e.g. in a historic tent camp), the client shall inform the artist in good time and both shall look for an alternative such as the artist's car.

Environmental influences:
At very low temperatures, the conjuring act can partly not be performed due to dexterity which suffers from it. Strong gusts of wind and precipitation can also (partly) hinder performances. Furthermore, there should be sufficient light and no excessive ambient noise for the magic act (a normal conversation should be possible). This is to be judged by the artist. If necessary, alternatives will be sought in consultation with the client. In the past this has always been possible.

Act:
Artist declares to be committed to the best of his or her ability within his or her field for the success of the event and sees the guest as the most important. Client declares to be familiar with the act of artist. (e.g. via this website)

Business card:
Artist has the right to hand over his own business card should an interested party specifically ask for it. Artist does not primarily promote his act.

Jew's harp sales (only as a magician):
Only when requested by the public the artist sells mouth harps once in a while. However, this is service to the public because of recurring enthusiastic questions from (mainly) children about them. The artist will not primarily promote this. The profit margin as well as the sales numbers are very marginal. Should the client object to this, please indicate this in good time.

Sound, photo and video recordings:
Recording of the artist for internal or private use is allowed.
Recordings of the artist by (or on behalf of) the client for promotional use of the event are permitted provided that only fragments of the act(s) are shown and must be approved for publication by the artist. Artist retains the right to use these or other recordings for his own promotion.
Recording of artist for professional or promotional use for or by third parties is only permitted after explicit agreement between artist and client.

Force majeure:
If the event cannot take place due to force majeure from outside (national mourning, restrictive measures by the government), the client is entitled to dissolve the agreement. Client will do his utmost for an equivalent replacement assignment. If the artist is unable to act due to force majeure he shall report this to the ordering customer as soon as possible and the artist shall be entitled to dissolve this agreement. The Artist shall do his utmost to find an equivalent replacement.
If the Client dissolves this agreement other than as a result of force majeure, the Artist shall be entitled (unless the Client makes an equivalent replacement offer) to charge the following: In the event of dissolution more than 1 month before the performance: 50% of the fee. In the event of dissolution less than 1 month before the performance: 100% of the fee.

Additional conditions regarding stage performances:

photo and video recordings:
The public is not allowed to make video recordings. Pictures are allowed but without flash. This is to avoid disturbing the show for the other guests and to prevent the entire show from appearing on the internet.
Jannes will communicate this in an appropriate way at the start of the performance.
